Digital Millenium Copyright Act Policy
1. General Statement
This policy is intended to implement the procedures described in the Digital Millennium Copyright Act, 17 U.S.C. Section 512 (”DMCA”) for the reporting of alleged copyright infringement. It is the policy of Nathan Thoms, associates, and subsidiaries (”Nathan Thoms”) to assist in the protection of the legitimate rights of copyright owners. Users of any part of Nathan Thoms’ websites that have the ability to post on it are required to comply with the legal protections provided under United States and international copyright laws.

Upon receipt of notification of a claimed infringement, Nathan Thoms will follow the procedures outlined herein and in the DMCA. Complaints made to the Designated Agent will be handled as described herein.
3. Complaint Notice Procedures for Copyright Owners
A notice of alleged copyright infringement delivered to the Designated Agent must include the following:
(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Nathan Thoms to locate the material.
(iv) Information reasonably sufficient to permit Nathan Thoms to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
(v) A statement that the complaining party has a good faith belief, and the reasons for that belief, that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Failure to include all of the above information may result in a delay of the processing of the DCMA notification.
4. Notice and Takedown Procedure
It is expected that all users of any part of this website or any other website of Nathan Thoms will comply with applicable copyright laws. However, if Nathan Thoms is notified of claimed copyright infringement, or otherwise becomes aware of facts and circumstances from which infringement is apparent or likely, he will respond expeditiously by removing, or disabling access to, the material that is claimed to be infringing or to be the subject of infringing activity, if Nathan Thoms has any reason to believe that the material is not covered by the exemption under 17 U.S.C. ยง 121. Nathan Thoms will comply with the appropriate provisions of the DMCA in the event a counter notification is received by its Designated Agent.
5. Accommodation of Standard Technical Measures
It is Nathan Thoms’ policy to accommodate and not interfere with standard technical measures he determines are reasonable under the circumstances, i.e., technical measures that are used by copyright owners to identify or protect copyrighted works.
